College of Law of United Arab Emirates University holds "Comparative Public and Civil Law" Symposium

In order to enhance strategic partnerships and achieve academic excellence according to the international standards, the College of Law held a scientific symposium entitled "Comparative Public and Civil Law" in various international legal systems, on Monday, November 7, 2016, at the College campus.  The symposium was held for the students of "Selected Studies in Comparative Law" course, as part of a series of legal lectures and workshops prepared by the College of Law. The Symposium was held in collaboration with the German international law firm "Hadler & Partner Rechtsanwalte Legal Consultant" for legal consulting in the Middle East and North Africa.  Guerin Hadler, international legal adviser and an expert in the international common, civil, and trade law at the company's branch in Abu Dhabi, and the College’s faculty members and students were in attendance.

Dr. Mohamed Hassan, Dean of the College of Law, explained, "The lecture is part of the innovative curriculum of the College to meet the current needs of the labor market and prepare the graduates of the College of Law to learn the latest public and comparative law. This is aimed at organizing the various relationships of which the State is a part, by using the means of public power, and aiming to achieve the public interest, as part of a series of symposia, lectures, and workshops on various major legal systems in the world. This is done in order to keep pace with the regional and international developments in this area, and develop a knowledge base specialized in branches of public law and to link it to different legal schools.  The mission of the University is to provide educational services of international standards for its students, with effective partnership with the concerned authorities to enhance knowledge in the community".

Hadler gave a presentation for students on the major legal systems in the world, especially the public law and English law systems. It included many models of procedures and different policies in the application of legal concepts and an explanation of their occupational details. It also included scientific discussions about the differences and similarities between these systems and the evolution of them, especially with regard to the judicial system and its procedures. It also addressed the sources of the legal base, and the role of case law and how to deal with it, especially in the English school of public and civil law. Hadler said that the public law or the so-called (common law), also called Anglo-Saxon Law, is the legal school that is rooted in the English legal heritage and a set of laws stemming from this school, and its most prominent feature is relying on case law as a source of binding legislation. On the other hand, the school of civil law has its roots in the European legal heritage, such as the “Code Napoleon”, especially the Roman Law. Within the states that follow the school of common law, the term is sometimes used in another sense, where it describes the unwritten customary laws, so the common law in this case corresponds to the written law issued by the legislatures, in addition to many of the procedures and systems related to studying these laws and its characteristics in a number of countries around the world.
